Occupancy Agreement, Assumption of Risk, and Park Rules

Juniper Lake RV Resort – Occupancy Agreement, Assumption of Risk, and Park Rules By checking the box and completing payment, the Guest affirms that they have read, understood, and agree to be legally bound by all terms below. Defined Term For purposes of this Agreement, “Resort” means: Juniper Lake RV Resort LLC, San Gabriel Rentals LLC, and their respective owners, members, managers, officers, employees, contractors, agents, affiliates, successors, and assigns. 1. Assumption of Risk Guest acknowledges that the property is a natural, outdoor, waterfront environment and contains inherent risks that cannot be eliminated. These risks include, but are not limited to: Drowning or injury in or near the lake, docks, or waterfront areas Slippery surfaces, mud, algae, or unstable ground Uneven terrain, holes, depressions, tree roots, stumps, and natural obstacles Retaining walls, elevation changes, and unmarked edges Falling branches, limbs, or trees, including due to wind, decay, or other natural causes Wildlife encounters (including but not limited to insects, snakes, venomous snakes, alligators, raccoons, and other wildlife) Weather-related hazards (including wind, lightning, and storms) Electrical hazards associated with RV hookups, pedestals, meters, and related infrastructure Acts or omissions of other guests or third parties Guest understands that such conditions may be open and obvious or hidden, and may change at any time. Guest acknowledges that the Resort does not guarantee the safety or condition of trees or natural features and assumes all risks associated therewith. Guest voluntarily assumes all risks, known or unknown, inherent or otherwise, whether arising from natural conditions, man-made conditions, or the ordinary negligence of the Resort. 2. Release and Waiver of Liability Guest RELEASES, WAIVES, DISCHARGES, AND AGREES NOT TO SUE the Resort from any and all claims, demands, causes of action, liabilities, or damages of any kind, including but not limited to those arising from: Personal injury Death Property damage or loss arising out of or related to Guest’s presence on or use of the premises, INCLUDING claims arising from the ordinary negligence of the Resort. 3. Indemnification Guest agrees to defend, indemnify, and hold harmless the Resort from and against any and all claims, demands, causes of action, liabilities, damages, losses, costs, and expenses (including attorney’s fees and court costs) arising out of or related to: Guest’s presence on or use of the premises Any injury, death, or property damage involving Guest The acts or omissions of Guest, Guest’s family members, children, occupants, visitors, or invitees Any violation of this Agreement by Guest This obligation applies regardless of whether such claims arise in whole or in part from the ordinary negligence of the Resort. 4. Guest Responsibility Guest is responsible for their own safety and the safety of all occupants, children, and visitors. Guest agrees to: Exercise caution at all times Avoid unsafe conditions Immediately report hazards or dangerous conditions to management 5. Electrical and Utility Safety RV hookups, pedestals, meters, and utility connections are inherently dangerous if mishandled. Guests are strictly prohibited from: Tampering with electrical equipment Opening panels, meters, or utility enclosures Modifying or altering any connections Any damage, defect, or hazardous condition (including exposed wiring or equipment damage caused by weather, falling limbs, or other causes) must be reported immediately. Any tampering or unauthorized modification shall be considered a serious violation and may result in immediate termination. Guest assumes all risks related to: Electrical use Improper hookup or misuse Damaged or exposed equipment 6. Damage and Repair Liability Guest is responsible for any and all damage to the Resort property, including but not limited to: Electrical pedestals, meters, wiring, and utility infrastructure Water, sewer, or hookup connections Buildings, laundry facilities, bathrooms, docks, and common areas Landscaping, trees, retaining walls, and grounds Any other property or equipment owned or maintained by the Resort This includes damage caused by: Guest Guest’s occupants, children, visitors, or invitees Guest’s RV, vehicle, or equipment Guest agrees to: Immediately report any damage Pay all costs of repair or replacement upon demand Guest authorizes the Resort to charge any credit or debit card on file for damages, repairs, or unpaid balances. The Resort reserves the right to: Repair damage without prior notice Charge the Guest for all associated costs, including labor, materials, and administrative fees Guest shall be responsible for damage resulting from misuse, improper use, or overloading of any electrical, water, sewer, or laundry equipment, including but not limited to electrical pedestals, breakers, meters, washers, dryers, and related infrastructure. Guest acknowledges that exceeding rated capacity, improper hookups, or failure to follow posted or common-sense usage guidelines may result in damage for which Guest is fully responsible. Failure to pay for damages shall constitute a violation of this Agreement and may result in termination of occupancy. 7. Waterfront Rules No lifeguard on duty Swimming and water use is strictly at your own risk Diving is prohibited Guests must exercise extreme caution near docks and shoreline 8. RV and Equipment Standards The following are not permitted: Pop-up campers Tent trailers Tents Truck campers Horse trailers RVs with canvas/fabric slide-outs RVs 10 years or older require prior approval. Current exterior photos must be submitted before arrival. All RVs must be fully self-contained. The Resort reserves the right to inspect any RV and deny or revoke occupancy if requirements are not met. 9. RV Changes Guests must notify management in advance of any RV change for approval. 10. Site Maintenance Sites must be kept clean, orderly, and in good condition Mold, mildew, algae, or similar buildup must be promptly removed One storage shed (maximum 50 sq. ft.) allowed with prior approval Sheds must be neutral in color and compatible with the RV All outdoor personal items must be capable of removal within 24 hours Under-RV storage is permitted only if the site remains neat and visually acceptable Refrigerators, freezers, or similar appliances are not permitted outside of the RV unless expressly approved by management 11. Occupancy Limits Each site includes up to three (3) occupants Additional occupants must be approved in advance and pay $50 per person, per month All occupants must be registered with management. Any person staying overnight for more than 3 nights in any 30-day period, whether consecutive or not, shall be deemed an occupant and must be registered, approved, and subject to all applicable fees. Guests may not circumvent occupancy limits through rotating or temporary visitors. 12. Criminal Background Restrictions Registered sex offenders and sexual predators, as defined under applicable law, are not permitted to reside at or occupy a site within the Resort. By entering into this Agreement, Guest represents and warrants that neither they nor any occupant are required to register as a sex offender under any state or federal registry. Violation of this provision shall constitute grounds for termination of occupancy to the extent permitted by applicable law. 13. Animal Feeding Prohibited Feeding wildlife or stray animals is strictly prohibited No food, scraps, or pet food may be left outside unattended 14. Child Supervision All children under 18 must be under direct supervision of a parent or legal guardian at all times. Direct supervision requires the adult to be physically present and able to immediately control the child’s behavior. Unsupervised minors are not permitted anywhere in the park, including but not limited to: Waterfront areas Docks Laundry room Bathrooms Open grass areas Parents/guardians are responsible for all actions, damages, and rule violations. Failure to comply may result in warnings, fines, or removal from the property. 15. Laundry Room and Bathroom Use Laundry room and bathroom facilities are restricted to individuals 18 years of age or older, unless accompanied by a parent or legal guardian. Unsupervised minors are not permitted in these facilities under any circumstances. 16. Park Conduct and Use Rules Quiet hours are from 10:00 PM to 7:00 AM. Excessive noise is prohibited at all times Disorderly conduct, public intoxication, or behavior that disturbs other guests is prohibited Each occupant is permitted one (1) vehicle. Total vehicles on a site may not exceed the number of approved occupants. Parking on roads, grass, or unassigned areas is prohibited Speed limit within the park is 10 mph unless otherwise posted Trash must be properly contained and disposed of. Littering or leaving trash on the ground is prohibited Commercial activity or business operations are not permitted without prior written approval Open fires, fire pits, and grills must comply with all local regulations and may be restricted or prohibited at any time 17. Enforcement and Termination Violations of this Agreement may result in: Warnings Fines Immediate termination of occupancy Serious or repeated violations may result in removal from the property. Upon termination, Guest shall vacate the premises within 72 hours, or sooner if required by safety considerations or applicable law. 18. Rent and Late Fees Monthly rent is due on the 1st of each month. If not paid within 5 calendar days: A late fee of $50 or 10% of the outstanding balance (whichever is greater) will be applied 19. Electronic Notice Guest agrees to receive communications and notices electronically, including by text message and email, in accordance with Florida Statutes § 668.50. Guest agrees that such notices shall be considered “in writing” and deemed delivered when sent to the contact information provided. Notwithstanding the foregoing, the Resort may also provide notice by: Posting notice on the RV or site Personal delivery Any other method permitted by applicable law 20. Governing Law This Agreement is governed by the laws of the State of Florida. Venue for any dispute shall be Walton County, Florida. 21. Binding Agreement; Responsibility for Occupants and Guests By checking the box and completing payment, Guest: Agrees to all terms of this Agreement on behalf of themselves and all occupants, family members, visitors, and invitees associated with their site Represents and warrants that they have full authority to accept and agree to these terms on behalf of all such persons Agrees that all occupants, guests, and invitees are subject to and must comply with all rules, policies, and provisions of this Agreement while on the property Accepts full responsibility and liability for all actions, conduct, damages, and violations caused by any occupant, guest, or invitee associated with their site Guest further agrees that: Any violation of this Agreement by an occupant, guest, or invitee shall be deemed a violation by the Guest The Resort may take enforcement action, including termination of occupancy, based on the conduct of any occupant, guest, or invitee Guest remains financially responsible for all damages, charges, fees, and losses caused directly or indirectly by any occupant, guest, or invitee
